Data & Privacy Policy
Last updated: June 19, 2026 · Effective date: June 19, 2026
1. Introduction
American Prime Sustainable Solutions Inc. ("American Prime", "we", "us", or "our") respects your privacy. This policy explains what information we collect when you use our agronomic analysis platform and related applications and API (the "Service"), how we use it, how we protect it, and the choices you have. "You" refers to the individual user and, where applicable, the organization on whose behalf you use the Service. This policy works together with our Terms of Use.
2. Our Commitment to Producers
Protecting the privacy of agricultural producers and the confidentiality of their operational and market data is a core priority. Two commitments guide everything in this policy:
- You own your data. You retain ownership of the field, crop, and agronomic data you upload. We act as a steward of that data, not as its owner.
- We protect your identity and your market data. We do not sell or disclose your identifiable data or your competitively sensitive operational information except as narrowly described in this policy. Where we create anonymized or aggregated data, we do so in a way that does not reveal any individual operation's identity, fields, or results.
This approach is consistent with the Privacy and Security Principles for Farm Data (the Ag Data Core Principles) maintained by the Ag Data Transparent organization.
3. Information We Collect
- Account information: Name, email address, phone number (optional), and role (producer, corporate, or administrator) collected at registration.
- Field and crop data: Field boundaries (GeoJSON), crop history (CSV), and related agronomic inputs you upload. You own this data. See Sections 2, 5, and 6.
- Analysis Outputs: Yield indices, nitrogen estimates, maps, scores, charts, and reports that we generate from your field and crop data and associate with your account.
- Usage data: Pages visited, features used, session duration, and browser or device metadata (IP address, user agent, viewport size), collected automatically to operate and improve the Service.
- Mobile app data: If you use our mobile app, we may collect device identifiers, app diagnostics and crash logs, and push notification tokens, and, with your permission, approximate or precise location.
- Communications: Support requests and messages you send us.
4. How We Use Your Information
- Provide the Service: Process field data and deliver analysis to you and, where applicable, your linked corporate account.
- Operate and improve the Service: Maintain, secure, troubleshoot, and improve the Service, including developing new features and improving the accuracy of our models. Section 7 explains how we use anonymized and aggregated data for this purpose.
- Communications: Send transactional messages (account verification, password reset, analysis completion). We do not send marketing emails without your consent, and you can withdraw that consent at any time.
- Legal compliance and protection: Respond to lawful requests from authorities, enforce our agreements, and protect the rights, property, and safety of our users, the public, and American Prime.
Today, our analysis uses platform based calculations, geospatial processing, and agronomic logic (for example, vegetation indices, nitrogen estimates, and yield potential), and we do not train machine learning models on your identifiable Customer Data. Running your data through our models to deliver results to you is part of providing the Service. We may use Anonymized and Aggregated Data to develop and improve our agricultural intelligence products, including planned capabilities such as yield forecasting, as described in Section 7. If we ever begin training models on your identifiable Customer Data, we will provide prominent notice and obtain your consent where applicable law requires.
5. Customer Data and Analysis Outputs
"Customer Data" means the field boundaries, crop history, agronomic inputs, and other data you upload. "Analysis Outputs" means the yield indices, nitrogen estimates, maps, scores, and reports that American Prime generates from Customer Data and associates with your account. You own your Customer Data. American Prime owns the Service and the models, algorithms, and technology used to generate Analysis Outputs, and grants you a license to use the Analysis Outputs associated with your account for your internal business purposes, as described in the Terms of Use.
6. Data Ownership
You retain full ownership of all Customer Data you upload. American Prime holds a limited, nonexclusive license to process your Customer Data to provide, secure, and improve the Service, and to create anonymized and aggregated data as described in Section 7. We do not sell, rent, or trade your identifiable Customer Data or the identifiable Analysis Outputs associated with your account. American Prime owns the Service, its models, algorithms, and technology, the Analysis Outputs it generates, and the anonymized and aggregated data and derived models described in Section 7.
7. Anonymized and Aggregated Data
This section describes how we create and use data that does not identify you, including for training our models and, in some cases, for marketing. Please read it carefully.
Definitions.
- Anonymized Data (also called "Deidentified Data") means data that we have processed so that it cannot reasonably be used to identify, and cannot reasonably be linked back to, you, your organization, or any individual field or operation.
- Aggregated Data means data that has been combined across multiple producers, fields, or regions so that no individual producer, field, or operation can be singled out.
How we create it. We may create Anonymized Data and Aggregated Data from account information, usage data, Customer Data, and Analysis Outputs.
How we use it. We may use and retain Anonymized Data and Aggregated Data for lawful business purposes related to operating, improving, securing, analyzing, benchmarking, developing, and marketing the Service and related agricultural intelligence products, including to:
- develop, train, test, validate, and improve our algorithms, models, and machine learning and artificial intelligence systems;
- benchmark performance and conduct research and analytics;
- improve, secure, and expand the Service and develop new products and services, including planned capabilities such as yield forecasting; and
- create marketing, promotional, educational, and informational materials, such as regional or crop level benchmarks and trends (for example, "across our network, average corn yield increased by a stated percentage year over year").
Protecting your identity and market data. We design our anonymization and aggregation so that published or shared outputs do not reveal any individual operation's identity, field boundaries, yields, or other competitively sensitive information. Before we publish or share Aggregated Data, we apply minimum aggregation thresholds so that results reflect groups of operations, never a single one. We commit not to attempt to identify any individual, organization, field, or operation from Anonymized Data, and we require any third party that receives Anonymized Data or Aggregated Data from us to make the same commitment.
Ownership and retention. American Prime owns all Anonymized Data, Aggregated Data, and any models, algorithms, benchmarks, and insights derived from them. Because this data does not identify you, we may retain and continue to use it after your account is closed, as permitted by law. The restrictions in Section 6 on selling, renting, or trading your identifiable Customer Data do not apply to Anonymized Data or Aggregated Data.
Your choice. If you prefer that we not use your Customer Data, even after anonymization or aggregation, to train or improve machine learning models, you may opt out by contacting us at contact@americanprime.co or through your account settings. We will apply your opt out prospectively within a commercially reasonable period after we receive and verify your request. An opt out does not require us to remove your data from Anonymized Data or Aggregated Data already created, and it does not limit our use of usage data needed to operate the Service.
8. Data Sharing and Disclosure
We share your information only in these circumstances:
- Within your organization: If your account is created, invited, paid for, or managed by an organization, cooperative, agronomic consultant, insurer, enterprise customer, or other account administrator, that administrator may access, manage, export, or delete the Customer Data and Analysis Outputs associated with your account, depending on the account settings and applicable agreement.
- Service providers: Third party vendors (cloud hosting, analytics, email delivery) who process data on our behalf under written agreements that limit their use of the data to providing services to us and prohibit using it for their own advertising or cross context purposes.
- Legal requirements: When required by law, court order, or government request, or to protect the rights, property, or safety of any person.
- Business transfers: In a merger, acquisition, financing, or sale of assets, information (including Customer Data) may transfer to the successor entity, which remains bound by commitments at least as protective as this policy.
- With your consent: When you explicitly request or authorize sharing.
We do not sell your personal information, your identifiable Customer Data, or the identifiable Analysis Outputs associated with your account. We do not use or share your information for cross context behavioral advertising. Our use of Anonymized Data and Aggregated Data is governed by Section 7.
9. Data Retention
We retain your account information and Customer Data for as long as your account is active. On account deletion we delete or anonymize your Customer Data within 90 days, except where retention is required for legal, audit, or contractual reasons. Anonymized Data and Aggregated Data may be retained as described in Section 7.
10. Security
We use administrative, technical, and organizational safeguards designed to protect information against unauthorized access, loss, misuse, or alteration, including encryption in transit, encryption at rest, access controls, and security reviews where appropriate. If a breach affecting your personal information occurs, we will notify you and the relevant authorities as required by applicable law. No method of electronic storage or transmission is completely secure, and we cannot guarantee absolute security.
11. Your Rights and Choices
Depending on your jurisdiction, you may have the right to:
- Access: Request a copy of the personal information we hold about you.
- Correction: Update or correct your information, including through your profile settings.
- Deletion: Delete your account through the Delete Account page. Account access is removed immediately; associated Customer Data is deleted or anonymized within 90 days, except where retention is legally or contractually required. Administrator accounts cannot be self deleted; if your account is administered by an organization, or you are the sole administrator of an organization account, contact contact@americanprime.co to arrange account closure.
- Data portability: Request an export of your Customer Data (field boundaries, crop history, analysis results) in a machine readable format.
- Opt out of nonessential email: Unsubscribe from nonessential emails using the link in any such email.
To exercise any of these rights, contact us at contact@americanprime.co. We will respond within the timeframes required by applicable law, and we will not discriminate against you for exercising your rights.
12. State Privacy Rights (United States)
If you are a resident of California or another state with a comprehensive privacy law, you may have additional rights, including the rights to know, access, correct, delete, and obtain a portable copy of your personal information, to opt out of the sale or sharing of personal information, and to be free from discrimination for exercising your rights. We do not currently sell personal information or share personal information for cross context behavioral advertising. If our practices change, we will update this policy and provide any opt out mechanism required by applicable law. We treat Anonymized Data and Aggregated Data as deidentified or aggregate information that falls outside these laws' definition of personal information, we maintain it in that form, and we commit not to attempt to identify individuals from it.
13. Agricultural Data
Some states may provide specific rights or protections for agricultural data. Where such laws apply, American Prime will comply with applicable requirements, including any requirement to obtain express written consent before selling identifiable agricultural data. American Prime does not sell identifiable Customer Data.
14. Users Outside the United States
The Service is intended for users in the United States, and your information is processed in the United States. If we offer the Service to users in other countries, we will provide any additional disclosures and safeguards those laws require.
15. Cookies and Tracking
The Service uses cookies, browser storage, and product analytics tools to maintain your session, remember your preferences, measure feature usage, and improve the Service. Some analytics tools may record how you interact with pages, such as clicks and navigation. We do not use behavioral advertising, and we do not sell tracking data to third parties.
16. Children's Privacy
The Service is intended for agricultural business use and is not directed at children under 13. We do not knowingly collect personal information from children under 13. If we learn that we have done so, we will delete it promptly.
17. Third Party Links
The Service may contain links to third party websites. We are not responsible for their privacy practices, and we encourage you to review their policies.
18. Changes to This Policy
We may update this policy periodically. We will update the "Last updated" date above. For material changes, including any expansion of how we use Customer Data, we will provide prominent notice and, where required by law, obtain your consent before the change takes effect. We will not apply material changes retroactively to data already collected without the notice and consent that applicable law requires.
19. Governing Law
This policy is governed by the laws of the State of Delaware without regard to conflict of law principles.
